In Pocatello, Idaho the judge apparently lost his patience with the defendant and ordered for him to have his mouth duct taped shut. The absurd move was ordered by Judge Peter D. McDermott during a probation violation hearing for Nicklas Frasure. Frasure was convicted of felony theft in 2008, but due to a mental disability the judge retained his jurisdiction. He is accused of violating his probation by not taking his medication. He has also been consuming alcohol, which has begun to alter his moods. During the hearing, Frasure interrupted the proceedings with repeated verbal outbursts and unusual behavior. Even after being told to keep quiet, he continued with the interruptions. That is when the judge ordered the bailiff's to silence him. The bailiff's found a roll of duct tape, ripped a piece off and plastered it on his mouth. It was later removed at the end of the hearing with Frasure asking, "You want to arm wrestle?" as he was being led out of the court room.
